Bratts consortium

Plus, Bratt is pushing for a member of the council to become a 4th director so the current board can operate again and vote Bratts new consortium into power. This option was actually mentioned by a current member of the council on RS earlier in the week

 

It is not the function of a Council to have either Officers or Councillors sit on the boards of private businesses. The individuals would need insurance against being made liable for losses arising from their decision making or business failure. In other words the Council has to take that responsibility directly or insure its representatives for it. That was found a few years ago to be ultra vires in a test case, albeit the Localism Act 2011 may now provide more flexibility.

 

I do not believe that is going to happen. An Officer is unlikely professionally to agree to it, there would be issues finding a Councillor with the skills and willingness and ability to secure nomination and as I have said it is highly dubious legally.

 

The Council has two main issues. The first is the recovery of the loan. The second is the social and economic well being of the City and how that is enhanced by the survival of Port Vale. It can take decisions and impose terms and conditions to get its work done from the outside.

Your initial statement is wrong, as Councillors sit on private companies already, such as housing associations. The Localism Act is silent on this matter.

 

Officers are bound by their contracts but - again - there is nothing specifically stopping them providing they declare an interest.

I just don't understand why Bratt wants to come back to Vale.

 

Is it to keep something hidden? Probably not because he wouldn't have resigned and sold his shares in the first place if he wanted to keep things under wraps.

 

So what is the attraction of PVFC to Bratt?

 

Or is it just pure hatred of potential new owner Mo Chaudry?

 

That's why Oliver is still in the board imho, to look after the books to protect Bill. No other reason for the campervan fan to still be here

Spot on!!!They have had so many delays in letting us see the books that it is so obvious they are in a mess.The worry is we may get further punishment should anything illegal be found:(

The man is a business goon and didn't get any substantial investment in eight years so have every faith he will fail to get the necessary together in less than a couple weeks. His ineptness is our gain, this time.

Don't worry folks, Lloyd told us at todays meeting there would be nothing else that would warrant any further points deductions.

Where a councill officer or councillor sits on a housing association board it will more than likelyhave been a condition of a stock transfer, where the stock previously belonged to the council but a newly formed HA takes on the ownership and management of a social housing stock. It is a different scenario, not sure about other private companies.

Fair points, although many Councillors sit on private company boards. They are generally not specifically prohibited from doing so.
