You have to claim constructive dismissal within 3 months !!

You could only issue a winding up order if a debt was overdue.

Something wrong somewhere.

Almost right. You have to submit your ETA within three months of the incident happening. It doesn't mean it has to be heard within that period. In my experience, they can take a long time with process etc. Most ETAs are settled out of court via a settlement to benefit the negative press, costs etc.

Have the supporters club clarified this as yet fully and asked for an answer on this from Smurf? I'm sure the original post on Facebook was swiftly removed?

Surely a man of the club for 30 plus years wouldn't try put the future of the club in doubt?

The supporters club posts have been put back on now

I didn't say heard, I said claim . Hearings can take a while to arrange but not that long.

Any sort of dismissal that doesn't comply exactly with legal requirements is breach of contract. It breaches your employment contract.

But people are saying its money orientated. Or final payment orientated? Is this constructive dismissal or breach of contract. I always thought constructive dismissal

Was removal from a position unfairly or without due process.

CD is when you actually resign because your employer has made your position intolerable. The money comes after to compensate for your loss.

Trying to remember circumstances at the time. Remember Grewy needing back surgery and it was at the time Page became manager. Remember Grewy saying he understood new manager wanting to bring in a new face and thought it was all amicable. Maybe there was a contract to be paid up but thought it came at a time when his contract had ended.

From what I understand of CD from being at the Citizens Advice Bureau after leaving a previous job under pressure over a molehill being made a mountain out of the rewards aren't that financially great. Can't imagine he would get more than a few grand if he won it, either way its stress the club and its fans don't need at the moment on top of everything else going on.

So piecing bits together Marks position at the club at the time was being made untenable by either the current owner or manager, and was asked to leave, using his required back surgery as

The reason. With the understanding that any remainder on the contract plus bonuses would be paid. However potentially this may not have happened, hence what we now believe may be happening.
