She remembered where the pizza had been left, made the decision to bend down and pick up the pizza (without any staggering or inbalance), she made the decision to go back to the room (without staggering or inbalance), she was cognisant to walk in the direction of the room and presumable find it. It's caught on camera and is indisputable. Look at the video.

Which goes to show she could of easily made the decision to get a taxi and go home. She didn't she made the decision to go back to the hotel.

What has that got to do with the consent in question?... perhaps if she wasnt capable of giving consent she wasnt capable of making the decision to go home.... its not about ability... its about capacity

Which goes to show how inconsistent our justice system is. Evans only mistake in this was not realising how drunk this girl apparently was, which is made harder by the fact he had also consumed a considerable amount of alcohol.

 

I wouldnt say that was his only mistake... not by a long chalk

The CCTV shows that she was capable of making decisions on her own she decided she was hungry and decided to go get a pizza. If she can make the decision that she needs food she can make the decision whether or not to have sex.

If we accept that point X marks the spot where she is too drunk does it matter if she is X+1 or X+10

I would he didn't force her to have sex, and consent was not the issue. It was that the judge said he should of realised she was to drunk to consent. Why should he realises was to drunk he in fact was also drunk? You can't use alcohol as an excuse in one persons side and then completely dismiss it in the other person's side.

No it doesnt mean the same.... a child is able to sign a contract but he isnt capable of entering into the contract... his age bars him in law, someone may be physically able but mentally incapable
